1) Overview
• These Terms govern your access to and use of the Level Up Displays website and store (“Services”). By placing an order or using the Services, you agree to these Terms and our Privacy Policy.
• If you do not agree, do not use the Services.
2) Eligibility and account
• You must be at least 18 years old (or the age of majority in your state/country) to purchase.
• If you create an account, you are responsible for keeping your login information confidential and for all activity under your account.
3) Orders, pricing, and availability
• All products are made to order. Processing times are shown on our Shipping Policy page.
• Prices are shown in U.S. dollars and may change without notice. Taxes and shipping are calculated at checkout.
• We may limit or cancel orders (e.g., suspected fraud or errors). If we change or cancel an order, we’ll attempt to notify you using the contact details provided.
4) Shipping, risk of loss, and delivery
• Shipping options, timelines, and any free‑shipping thresholds are described in our Shipping Policy.
• Risk of loss passes to you when the carrier takes possession of the package. Please ensure your shipping address is accurate.
5) Returns, exchanges, and damages
• Our Returns & Refunds Policy applies to all purchases. In short: framed displays are final sale. For damage or incorrect items, contact heartsandhits@gmail.com with photos so we can assist with a replacement where eligible.
6) Intellectual Property
• Fan art notice. Our products feature unofficial fan art and extended art displays intended for collectors of official TCG cards. We have no affiliation, association, authorization, endorsement, or sponsorship by Nintendo, The Pokémon Company, or Pokémon in any way. Our products and artwork should be treated as fan-created works meant to enhance official card collections.
• Ownership of content. All content on the Services (including designs, artwork, images, text, graphics, page layouts, and compilations) is owned by or licensed to Level Up Displays and is protected by applicable intellectual property and other laws. All rights not expressly granted are reserved by Level Up Displays.
• Trademarks. Level Up Displays’ names, logos, product and service names, designs, and slogans are trademarks or trade dress of Level Up Displays or its affiliates or licensors. You may not use any of these marks without Level Up Displays’ prior written permission. Shopify’s name, logo, product and service names, designs, and slogans are trademarks of Shopify. All other names, logos, product and service names, designs, and slogans that appear on the Services are the property of their respective owners and are used for identification purposes only.
• Limited license for site use. Subject to your compliance with these Terms, we grant you a limited, non‑exclusive, non‑transferable, revocable license to access and use the Services for personal, non‑commercial shopping and ordering purposes. Except as expressly permitted, you may not copy, reproduce, modify, distribute, display, perform, publish, create derivative works from, or exploit any part of the Services without our prior written consent.
• Third‑party rights. Any third‑party trademarks, copyrighted works, or other intellectual property depicted in product titles, descriptions, tags, or comparative references remain the property of their respective owners. No license or right is granted to you by implication, estoppel, or otherwise.
• Reporting concerns. If you believe any content on the Services infringes your intellectual property rights, please contact us with sufficient detail to identify the material and your ownership so we can review and respond appropriately.
7) User content and acceptable use
• If you submit reviews, images, or other content, you grant Level Up Displays a non‑exclusive, worldwide, royalty‑free license to use, reproduce, and display that content in connection with the Services.
• You agree not to misuse the Services (e.g., no unlawful, infringing, harassing, or harmful activity; no attempts to bypass security; no automated scraping without permission).
8) Disclaimer of warranties
• The Services and all products are provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non‑infringement. Some jurisdictions do not allow limitations on implied warranties, so these may not apply to you.
9) Limitation of liability
• To the maximum extent permitted by law, Level Up Displays and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Services or products. Our total liability for any claim will not exceed the amount you paid for the product giving rise to the claim.
• Damage from installation or placement. You are solely responsible for securely installing and mounting your display. Level Up Displays is not responsible for any damage to your product display, trading cards, customer cards, or graded slabs resulting from failure to properly secure or mount the display to a wall or other location, improper placement, or environmental conditions (including but not limited to falls, vibrations, moisture, or heat).
10) Indemnification
• You agree to indemnify and hold harmless Level Up Displays and its affiliates from any claims, losses, liabilities, damages, costs, or expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or misuse of the Services.
11) Privacy
• Our collection and use of personal information is described in our Privacy Policy.
12) Changes to the Services or Terms
• We may modify or discontinue the Services (in whole or part) and update these Terms at any time. Changes are effective when posted. Your continued use of the Services after changes means you accept the updated Terms.
13) Governing law; disputes
